IMPORTANT: These Terms of Service ("Terms") constitute a legally binding agreement between you and Touge Town Corporation. By accessing our website, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
1. Acceptance of Terms
By accessing or using any services provided by Touge Town Corporation, including but not limited to accommodation bookings, vehicle rentals, route guidance, and related tourism services, you expressly agree to:
- Comply with all terms, conditions, and obligations set forth in this agreement
- Abide by all applicable laws and regulations of Japan
- Accept full responsibility for your actions while using our services
- Acknowledge that you have the legal capacity to enter into this binding contract
2. Service Description
Touge Town Corporation provides the following services:
- Accommodation Services: Self-check-in lodging units in Shibukawa, Gunma Prefecture
- Vehicle Rental Services: Rental of performance and specialty vehicles for mountain pass (touge) driving experiences
- Route Information: Guidance on scenic mountain pass routes in the Gunma region
- Cultural Experiences: Initial D themed tourism experiences
- Merchandise: Branded apparel and accessories
SERVICE DISCLAIMER: All services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
3. Eligibility and Age Requirements
3.1 General Eligibility
- You must be at least 18 years of age to use our services
- You must possess valid government-issued identification
- You must have the legal capacity to enter into binding contracts under Japanese law
- You must not be prohibited from using our services under any applicable laws
3.2 Vehicle Rental Requirements
- Minimum age: 21 years (25 years for high-performance vehicles)
- Valid driver's license from your home country AND valid International Driving Permit (IDP)
- Minimum 2 years of driving experience (5 years for high-performance vehicles)
- Clean driving record with no major violations in the past 3 years
- Valid credit card for security deposit authorization
4. Vehicle Rental Terms
4.1 Rental Agreement
All vehicle rentals require execution of a separate rental agreement at the time of pickup. By renting a vehicle, you agree to:
- Conduct a thorough pre-rental inspection and report any existing damage
- Operate the vehicle safely and in accordance with all traffic laws
- Return the vehicle in the same condition as received, normal wear excepted
- Pay all applicable rental fees, security deposits, insurance premiums, and taxes
- Report any accidents, damage, or mechanical issues immediately
4.2 Security Deposit
A security deposit of ¥50,000 to ¥500,000 (depending on vehicle class) will be authorized on your credit card at the time of rental. This deposit will be released within 14 days of vehicle return, subject to:
- No damage to the vehicle
- No traffic violations or fines incurred
- Vehicle returned on time with full fuel tank
- No smoking or prohibited substances used in vehicle
4.3 Insurance and Liability
Basic insurance is included in rental rates, providing:
- Third-party liability coverage (minimum required by Japanese law)
- Collision damage waiver with ¥100,000 deductible
- Theft protection with ¥100,000 deductible
CRITICAL INSURANCE DISCLAIMER: You are personally liable for ALL damages up to the deductible amount. Optional full coverage insurance is available for additional fee. Insurance is VOID if you operate the vehicle:
- Under the influence of alcohol or drugs
- In violation of traffic laws (racing, excessive speed, reckless driving)
- On closed or prohibited roads
- Without proper licensing or authorization
- After providing false information on rental application
4.4 Prohibited Activities - Vehicles
The following activities are STRICTLY PROHIBITED and will result in immediate termination of rental agreement, forfeiture of all deposits, and potential legal action:
- Street racing, drifting, or competitive driving on public roads
- Exceeding posted speed limits
- Operating vehicle on closed or restricted roads
- Allowing unauthorized drivers to operate the vehicle
- Smoking or using illegal substances in the vehicle
- Modifying or tampering with vehicle equipment
- Using vehicle for commercial purposes (ride-sharing, delivery, etc.)
- Transporting hazardous materials
- Operating vehicle outside of Gunma Prefecture without prior written authorization
4.5 Mountain Pass (Touge) Driving Safety
EXTREME RISK WARNING: Mountain pass driving involves inherent and significant risks including but not limited to: narrow roads, steep grades, sharp curves, blind corners, falling rocks, adverse weather conditions, wildlife, limited cellular service, and potential for serious injury or death. By renting our vehicles for touge driving, you:
- ACKNOWLEDGE these risks and ACCEPT FULL RESPONSIBILITY for all consequences
- AGREE that Touge Town Corporation is NOT LIABLE for any injuries, damages, or losses
- ASSUME ALL RISK associated with mountain driving activities
- AGREE to drive defensively, maintain safe speeds, and exercise extreme caution
- UNDERSTAND that road conditions may change rapidly due to weather, time of day, or season
5. Accommodation Terms
5.1 Booking and Reservations
- All bookings require advance payment via credit card
- Check-in time: 3:00 PM (15:00) / Check-out time: 11:00 AM (11:00)
- Early check-in or late check-out subject to availability and additional fees
- Self-check-in instructions will be provided via email 24 hours prior to arrival
- Failure to check-in within 24 hours of scheduled arrival may result in booking cancellation without refund
5.2 House Rules
All guests must comply with the following house rules:
- Quiet Hours: 10:00 PM - 7:00 AM daily
- No Smoking: All units are strictly non-smoking. Violation results in ¥50,000 cleaning fee
- No Parties: Gatherings exceeding registered guest count are prohibited
- No Pets: Animals are not permitted except registered service animals
- Maximum Occupancy: Strictly enforced. Unauthorized guests result in immediate eviction
- Cleanliness: Maintain reasonable cleanliness. Excessive cleaning required may incur additional fees
- Respect Property: Treat property with care. You are liable for all damages beyond normal wear
5.5 Apartment-Specific Policies
NO ELEVATOR ACCESS:
- All guest apartments are located on Levels 3, 4, and 5
- There is NO ELEVATOR anywhere in the building
- Access is STAIRS ONLY from ground level to your apartment
- Level 3 apartments: Approximately 2 flights of stairs
- Level 4 apartments: Approximately 3 flights of stairs
- Level 5 apartments: Approximately 4 flights of stairs
- Heavy luggage or mobility concerns? Please book lower-level apartments (Level 3) or consider alternative accommodation
- Guests with limited mobility should NOT book Level 5 apartments
NO ON-SITE PARKING:
- There is NO PARKING available at the Touge Town property
- Public parking available nearby (approximately 5-minute walk)
- Guests arriving by rental car: Plan for off-site parking
- Parking fees are the guest's responsibility
Rooftop Access Rules:
- Rooftop terrace available to registered guests only
- Access permitted until 10:00 PM (22:00) sharp — NO EXCEPTIONS
- Rooftop closes promptly at 10:00 PM out of respect for residential neighbors
- BBQ facilities available with advance booking only (48-hour notice)
- No external visitors permitted on rooftop at any time
Quiet Hours & Residential Area:
- Quiet hours: 10:00 PM - 7:00 AM daily (strictly enforced)
- Touge Town is located in a residential neighborhood
- Please be respectful of neighbors at all times
- Excessive noise will result in immediate termination of booking
Additional Amenities (Request in Advance):
- Futon Rental: Available in Large rear apartments only (302, 402, 502) for additional sleeping capacity — advance booking required
- IH Cooktop: Portable induction cooktop available on request — 24-hour advance notice required, limited availability
- Light kitchenette standard in all units (microwave, kettle, toaster, bar fridge)
5.6 Level 5 Mobility Warning
ACCESSIBILITY WARNING — LEVEL 5 APARTMENTS (501, 502):
Level 5 apartments require climbing approximately 4 flights of stairs from ground level with NO ELEVATOR option. These apartments are:
- NOT SUITABLE for guests with limited mobility
- NOT SUITABLE for guests with heavy luggage
- NOT RECOMMENDED for elderly guests or families with small children requiring stroller access
- PHYSICALLY DEMANDING — multiple daily trips up and down stairs required
By booking a Level 5 apartment, you acknowledge and accept full responsibility for the physical demands of stair access.
5.3 Property Damage
Guests are financially responsible for any damage to the property, furnishings, or equipment caused during their stay. This includes but is not limited to:
- Broken furniture, fixtures, or appliances
- Stains, burns, or excessive dirt requiring professional cleaning
- Missing items or equipment
- Damage to walls, floors, or ceilings
- Plumbing or electrical issues caused by misuse
Damage costs will be charged to the credit card on file. Disputes must be submitted in writing within 48 hours.
5.4 Exclusive Guest Access & No-Party Policy (Strict)
REGISTERED GUESTS ONLY — NO EXCEPTIONS: Access to all TougeTown guest facilities is strictly limited to registered guests only. This policy applies to all accommodations, including individual units and "Book the Block" group bookings.
This includes:
- All guest apartments and accommodation units
- The rooftop guest area and terrace facilities
- BBQ facilities and common areas
- Guest parking areas
- Guest vehicles (rental fleet)
STRICT ENFORCEMENT:
- Only guests listed on the booking are permitted on-site
- No additional visitors are allowed at any time, for any reason
- No parties, gatherings, or events involving non-registered guests
- All guests must be named on the booking confirmation
- Photo ID verification required for all registered guests
ROOFTOP TERRACE RULES (Book the Block guests):
- Exclusive private use for registered guests only
- Rooftop use permitted until 10:00 PM (22:00) sharp
- No external visitors permitted on rooftop at any time
- BBQ facilities available with advance booking only
CONSEQUENCES OF VIOLATION: Any violation of this policy will result in:
- Immediate termination of booking without refund
- Immediate eviction from property
- Forfeiture of all payments and security deposits
- Additional penalty fee of ¥100,000
- Potential police involvement for trespassing
- Permanent ban from all TougeTown properties and services
RATIONALE: This strict policy protects guest safety, maintains property security, ensures neighborhood harmony, and complies with Japanese minpaku regulations and insurance requirements.
NO EXCEPTIONS will be made to this policy under any circumstances.
6. Payment Terms
6.1 Accepted Payment Methods
We accept the following payment methods:
- Credit cards: Visa, Mastercard, American Express, JCB
- Debit cards with major card network logos
- Bank transfer (for bookings made more than 14 days in advance)
6.2 Payment Schedule
- Accommodation: Full payment due at time of booking
- Vehicle Rental: 50% deposit at booking, balance due at pickup
- Security Deposits: Authorized at time of service commencement
6.3 Currency and Pricing
All prices are quoted in Japanese Yen (¥JPY) unless otherwise specified. Prices displayed in other currencies are estimates only and subject to exchange rate fluctuations. You are responsible for any currency conversion fees charged by your financial institution.
6.4 Taxes and Fees
Published prices do not include:
- Japanese consumption tax (currently 10%)
- Accommodation tax (varies by municipality)
- Vehicle rental insurance premiums
- Fuel charges
- Late return fees
- Damage or cleaning fees
- Traffic violation fines or penalties
7. Cancellation and Refund Policy
7.1 Accommodation Cancellations
- More than 30 days before check-in: Full refund minus ¥5,000 processing fee
- 15-30 days before check-in: 50% refund
- 7-14 days before check-in: 25% refund
- Less than 7 days before check-in: No refund
- No-show: No refund
7.2 Vehicle Rental Cancellations
- More than 14 days before pickup: Full refund of deposit
- 7-14 days before pickup: 50% refund of deposit
- Less than 7 days before pickup: No refund of deposit
- No-show: No refund; full rental charges apply
7.3 Company-Initiated Cancellations
We reserve the right to cancel any booking at our sole discretion due to:
- Safety concerns (weather, road conditions, vehicle mechanical issues)
- Property maintenance or unavailability
- Violation of terms or provision of false information
- Force majeure events (see Section 14)
In case of company-initiated cancellation, you will receive a full refund of all payments made. We are not liable for any consequential damages, travel expenses, or other costs incurred.
8. Assumption of Risk
EXPLICIT ASSUMPTION OF ALL RISKS: You explicitly acknowledge, understand, and voluntarily assume ALL risks associated with using our services, including but not limited to:
- Mountain Driving Risks: Vehicle accidents, collisions, rollovers, falling off cliffs, injuries, or death
- Weather Risks: Snow, ice, rain, fog, landslides, fallen trees, flooding
- Road Condition Risks: Potholes, debris, rockslides, unmarked hazards, poor visibility
- Wildlife Risks: Animal collisions, unexpected wildlife encounters
- Communication Risks: Limited or no cellular service in mountain areas
- Medical Emergency Risks: Delayed emergency response times in remote areas
- Accommodation Risks: Equipment malfunction, utility failures, natural disasters
- Criminal Activity Risks: Theft, vandalism, assault (though extremely rare in Japan)
YOU ACCEPT FULL AND COMPLETE RESPONSIBILITY FOR ALL CONSEQUENCES RESULTING FROM YOUR USE OF OUR SERVICES.
9. Limitation of Liability
MAXIMUM LIABILITY CAP: To the fullest extent permitted by Japanese law, Touge Town Corporation's total aggregate liability for any and all claims arising from or related to our services is strictly limited to the amount you paid for the specific service giving rise to the claim.
EXCLUSION OF CONSEQUENTIAL DAMAGES: Under no circumstances shall Touge Town Corporation be liable for:
- Indirect, incidental, consequential, special, exemplary, or punitive damages
- Loss of profits, revenue, business opportunities, or data
- Personal injury, property damage, or death resulting from your use of our services
- Costs of substitute services or accommodations
- Travel expenses, flight cancellations, or schedule disruptions
- Emotional distress, mental anguish, or loss of enjoyment
THIRD-PARTY ACTIONS: We are not responsible for the actions, omissions, or negligence of third parties including but not limited to other drivers, property owners, emergency services, utility providers, or telecommunications companies.
10. Indemnification
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Touge Town Corporation, its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of our services
- Your violation of these Terms
- Your violation of any rights of third parties
- Your violation of any applicable laws or regulations
- Your negligent, reckless, or intentional misconduct
- Any damage you cause to vehicles, property, or persons
- Any traffic violations, fines, or penalties incurred during vehicle rental
- Any false or misleading information you provide
11. Insurance Requirements
11.1 Mandatory Travel Insurance
HIGHLY RECOMMENDED: We strongly recommend that all guests purchase comprehensive travel insurance covering:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Personal accident and death benefits
- Personal liability coverage
- Baggage and personal effects
11.2 Vehicle Rental Insurance
Basic vehicle insurance is included in rental rates but has significant deductibles and exclusions. Optional supplemental insurance is available and recommended.
12. Prohibited Activities
The following activities are STRICTLY PROHIBITED on our premises or while using our services:
- Illegal drug use, possession, or distribution
- Excessive alcohol consumption or drunk driving
- Weapons possession (firearms, knives, explosives)
- Prostitution or illegal sexual activities
- Gambling or illegal gaming
- Harassment, discrimination, or threatening behavior
- Unauthorized commercial activities or filming
- Tampering with safety equipment or security systems
- Disturbing other guests or neighbors
Violation of these prohibitions will result in immediate termination of services, forfeiture of all payments, eviction from property, and potential criminal prosecution.
13. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Touge Town Corporation and is protected by Japanese and international copyright, trademark, and intellectual property laws.
You may not:
- Copy, reproduce, distribute, or publicly display our content without written permission
- Use our trademarks, logos, or branding without authorization
- Create derivative works based on our content
- Use automated systems (bots, scrapers) to access our website
14. Force Majeure
Touge Town Corporation shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, typhoons, floods, volcanic eruptions)
- Acts of war, terrorism, or civil unrest
- Government actions, regulations, or travel restrictions
- Pandemics, epidemics, or public health emergencies
- Utility failures (power, water, internet, telecommunications)
- Labor disputes or strikes
- Supplier or contractor failures
In the event of force majeure, we will make reasonable efforts to provide alternative services or refunds, but we are not obligated to do so.
15. Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time without prior notice. Material changes will be communicated through:
- Prominent notice on our website
- Email notification to registered users
- Updated "Last Updated" date at the top of this document
Your continued use of our services after such changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of our services immediately.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented at the time of booking, constitute the entire agreement between you and Touge Town Corporation regarding your use of our services. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
18. Dispute Resolution
18.1 Informal Resolution
In the event of any dispute, claim, or controversy arising from or relating to these Terms or our services, you agree to first attempt to resolve the matter informally by contacting us at contact@tougetown.com. We will make good faith efforts to resolve the dispute within 30 days.
18.2 Arbitration (Optional)
If informal resolution fails, you may opt for binding arbitration in accordance with the Commercial Arbitration Rules of the Japan Commercial Arbitration Association (JCAA). Arbitration shall be conducted in English and Japanese in Tokyo, Japan.
18.3 Litigation
If arbitration is not elected, any legal action must be brought exclusively in the courts of Shibukawa, Gunma, Japan. You irrevocably consent to the personal jurisdiction of these courts and waive any objection to venue.
19. Governing Law
GOVERNING LAW AND JURISDICTION: These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Shibukawa, Gunma, Japan.
You irrevocably waive any right to a jury trial and consent to personal jurisdiction in Japanese courts.
20. Language
These Terms are provided in English and Japanese. In the event of any conflict or inconsistency between versions, the Japanese language version shall prevail and be binding.
